Horizon parking charge.

Have any of you fine gentlemen had any history with these.
About four months ago I parked in Cleveland centre car park and thinking the barriers were raised I presumed they were out of action not realising that VNR was in action.
I appealed to POPLA and lost my appeal and probably should have paid the £80; fine.
This has since been passed on to a debt recovery service who now want £160. Should I just pay or ignore it.

Parking charges - on private land are unenforceable because it's the DRIVER that is responsible and not the owner.

You simple write to them and say the driver was Mr M Mouse, 15 Disney Street, Disney world etc (obviously use a real address).

But once you've admitted you are the driver you have entered into a commercial contract and you are fucked.

Parking charges on council land are different, they make the owner of the vehicle liable.

Do yourself a favour and just pay this thing or the debt collection agency will multiply the fee and then apply for a court order against you. Then they will have right to remove goods and fuck up your credit score.

Whilst its correct you have entered a "contract" it really boils down to 2 choices.

Pay it
or
Run the gauntlet.

Have you admitted you were the driver? Under current legislation Horizon CANNOT hold a registered keeper of a vehicle responsible.

If you have not admitted you were the driver tell them you were not driving so the penalty charge notice (its not a fine!) The NTK, is non protection of freedoms act (POFA).

Its sometimes less grief to pay the fine but if you enjoy a little challenge its always worth a go.

Yep. Unfortunately I told them when I appealed.  It had been years since I last parked at CC and you had to get a ticket from the barrier.  I didn't realise they had changed the system. 
Probably should have paid up straight away but I honestly thought I was in the right

I was successful in an appeal against a notice at Scotch Corner Tesla charging station by pointing out in some detail how their was insufficient warning of the ANPR system being in operation or that registration at the hotel was a pre condition of entering to park

I was able to argue that I hadn't left the car so had not in fact parked or entered into a contract.

I also copied in Holiday Inn and moaned at them about rogue parking operators working on their premises.

It was a right fuck on though and even at £20 an hour for my time I'd have been better off just paying up - but that's what they rely on (the cunts)

With PCNs it's all about the signage..was the signage clear and big enough for you to read and to enter into any contract with Horizon... Get some photos and read up on how Horizon act with court (loads on the moneysupermarket forums).

Also, the signage has to be at the ENTRANCE to the car park as this is where the contract starts. No signage at the entrance, then no contact

MSE Parking forums - No need to pay on private land - pm me if you want more of a lowdown. Popla are ran by the scumbag parking clampers and their slimey solicitors.

I've had 12 tickets in court, won the lot. It will take some time to prepare for it but it's very doable.

Paying for nowt. Going to court.
