My mate was doing a bit of graft for someone who didnt drive, so the bloke hired a van for my mate to drive ( he has a licence but no car, so no insurance himself). Anyway my mate sideswiped the van on another car so damaged the hire van,he stopped and checked the van and car, but nobody came out to check car so he drove off. The bloke who hired van lied when he took the van back and told the hire company that someone must of drove passed and sideswipe the van!!!! It was a taxi he hit and now cctv as emerged (he as not seen it yet) and the taxi company got onto the hire company now the company are trying to charge the bloke who hired the van £700 for the damage to the van. And are wanting my mate to pay for the damage to the Taxi or they will go to the police and he will be charged with hit and run, or whatever the offence will be.The hire company gave my mate a insurance certificate to drive the van, so surely the insurance from the hire company should pay for the damage??? Isnt this how insurance works??? Maybe the bloke should have to pay a bit of excess but not £700 and the money for the Taxi!!! Anyone any idea???

Scandalous. Surely the excess would cover it. What was he supposed to do? Sit round all day, waiting for the driver to return?

Depends on the cover he took out,I hired a car last year with a £700 excess, for an extra £30 they reduced the cover to £150. If he took out standard cover there is a big excess to pay but he should be covered for all damage, paying for the taxi bit is them coming it.Its not a police matter.

1st thing that needs clearing up is.
The bloke that hired the van did HE drive the van or did his mate drive it? Unless he named as a driver also then the insurance will become invalid which is then "criminal" not "civil".

If he was named then the "Hirer" really needs to see what EXACTLY he was covered for. They do push the "more cover". That will tell him EXACTLY what excess etc would be.

Im surprised at the hire company not asking for an indy quote for the damage to the taxi.🤔

Find out the basics then get back to us!
If the basics are all covered then i already have your "pals",(ahem! 🤣🤣👍), "defence". 👍

The bloke that hired the van did not drive it, he dosent drive, my mate went with him to hire it. Insurance was in my mates name.

They never pushed for more insurance, they just gave him a insurance certificate incase he was pulled over by police.

One of the things you need to check is what the cover was. Did your mate take out Fully Comprehensive Insurance or just Third Party Insurance ?Some smaller hire companies don't fully explain this to hirers. Also ask for photographic proof of the alleged damage.Unfortunately though leaving the scene of an accident without exchanging details could possibly lead to police involvement.

There was nobody to exchange details with! Apparently.

If he was insured why would he not just take a few pics on his phone of the damage and fess up? You'd assume that the damage to the van would eat up the excess anyway.

I'm assuming there would be a big number on the side of the taxi to phone.. sounds like your mate has dropped a bollock tbh. The taxi company will want to make the most of it and the hire company will want to pay as little as possible.

I'd be very surprised if the insurance wasn't fully comp but the excess might be heavy. Your mate has a legal obligation to exchange details or make reasonable attempts to contact the owner of the taxi.. failure to do so could make the insurance invalid. Tricky!
