If it goes hard when stale it's a cake, if it goes soft when stale, it's a biscuit

Sweet and spongy is a cake, flattish and hardish is a biscuit. Simple

Does the cake want to identify as a biscuit?

I think there are deeper issues at play here.

Just because the cake was made a sponge who are we to say that with patience, love and understanding it COULD become a biscuit?

Good point, Kenny. I suppose we are all being thoughtless cavemen. It could identify as a cat. I think I need to sign up on flyme so they can educate me in their ways. I'm ashamed of myself.

I believe this was the principal applied by McVities when determining the classification of the jaffa cake
